Denying federal benefits to gay couples ruled unconstitutional

The Defense of Marriage Act, which denies federal benefits to same-sex couples, was declared unconstitutional Thursday. NBC's Matt Lauer reports.

Updated at 2:30 p.m. ET: A federal?appeals court has ruled that the Defense of Marriage Act, a law that denies a host of federal benefits to same-sex married couples, is unconstitutional.

The 1st U.S. Circuit Court of Appeals in Boston ruled Thursday that the act known as DoMA, which defines marriage as a union between a man and a woman, discriminates against gay couples.


The law was passed in 1996 at a time when it appeared Hawaii would legalize gay marriage. Since then, many states have instituted their own bans on gay marriage, while eight states have approved it, led by Massachusetts in 2004, and followed by Connecticut, New York, Iowa, New Hampshire, Vermont, Maryland, Washington state and the District of Columbia. Maryland and Washington?s laws are not yet in effect and may be subject to referendums.

The appeals court agreed with a lower court judge who ruled in 2010 that the law is unconstitutional because it interferes with the right of a state to define marriage and denies married gay couples federal benefits given to heterosexual married couples, including the ability to file joint tax returns.

The 1st Circuit said its ruling wouldn?t be enforced until the U.S. Supreme Court decides the case, meaning that same-sex married couples will not be eligible to receive the economic benefits denied by DOMA until the high court rules.

Attorney Paul Clement, who represented the House of Representatives in defending DOMA, told msnbc.com that no decisions on legal strategy have been made.

?But we have always been clear we expect this matter ultimately to be decided by the Supreme Court, and that has not changed,? he said.

Gay & Lesbian Advocates & Defenders, the Boston-based legal group that brought one of the lawsuits on behalf of gay married couples, said the court agreed with the couples that it is unconstitutional because it takes one group of legally married people and treats them as "a different class" by making them ineligible for benefits given to other married couples.

"We?ve been working on this issue for so many years, and for the court to acknowledge that yes, same-sex couples are legally married, just as any other couple, is fantastic and extraordinary," said Lee Swislow, GLAD?s executive director.

During arguments before the court last month, a lawyer for gay married couples said the law amounts to "across-the-board disrespect." The couples argued that the power to define and regulate marriage had been left to the states for more than 200 years before Congress passed DoMA.

An attorney defending the law argued that Congress had a rational basis for passing it in 1996, when opponents worried that states would be forced to recognize gay marriages performed elsewhere. The group said Congress wanted to preserve a traditional and uniform definition of marriage and has the power to define terms used to federal statutes to distribute federal benefits.

More than 1,000 benefits in question
Two California federal judges earlier said the act violated constitutional standards.

Judge Claudia Wilken of Oakland ruled May 24 that the law legalized bigotry by withholding more than 1,000 federal benefits -- such as joint tax filing, Social Security survivor payments and immigration sponsorship -- from gays and lesbians legally married under state law.

Judge Jeffrey White of San Francisco also declared DoMA unconstitutional and ordered the government to provide family insurance coverage to the wife of a lesbian court employee. White's ruling has been appealed to the Ninth U.S. Circuit Court of Appeals, which will hear the case in September.

President Barack Obama withdrew his administration's defense of the law in February 2011, saying he considered it unconstitutional. House Speaker John Boehner convened the Bipartisan Legal Advisory Group to defend it. The legal group argued the case before the appeals court.

On May 9, Obama declared in an interview with ABC News his unequivocal support for gay marriage, becoming the first president to endorse the?idea.

Obama said, "I have hesitated on gay marriage in part because I thought that civil unions would be sufficient." He added that he "was sensitive to the fact that for a lot of people the word 'marriage' was something that invokes very powerful traditions, religious beliefs and so forth."

Now, he said, "it is important for me personally to go ahead and affirm that same-sex couples should be able to get married."

Two of the three judges who decided the case Thursday were Republican appointees, while the other was a Democratic appointee. Judge Michael Boudin, who wrote the decision,?was appointed by President George H.W. Bush, while Judge Juan Torruella was appointed by President Ronald Reagan. Chief Judge Sandra Lynch is an appointee of President Bill Clinton.

Groups slam, praise ruling

It?s obvious that the federal courts on both coasts are intent on imposing their liberal, elitist views of marriage on the American people.?

  • "This is one more powerful statement now from an appellate court following four other federal courts that the so-called Defense of Marriage Act is indefensible under the constitution and should be discarded," Evan Wolfson, founder and president of Freedom to Marry, told msnbc.com. "It?s obviously a great victory not just for families harmed by federal marriage discrimination but for the country. Hopefully it will help us get back to our normal practice of the federal government respecting the marriages celebrated in the states without a gay exception."

Guide Dog Lessons

On 9-11, 2001, I was at my desk on floor seventy eight of Tower One of the globe Trade Center. I arose to induce some letterhead from a cupboard once I heard an explosion. The United States had been attacked by terrorists.

When the impact, the building shuddered and tipped. Roselle decided it had been time to get up. She emerged, yawned, and quietly sat, expecting a command from me. "Time to go to work", I said. Forward, I commanded her softly. Forward is used when setting off with the dog in harness, and it's one among the terribly 1st commands all guide dogs are taught.

After insuring others in my offices had evacuated Roselle, A colleague David Frank and that i headed out of the office and visited the nearest stairwell. Every tower had 3 such stairwells. White House Petitioned to Make Research Free to Access

More than 17,000 people have signed an online petition urging US President Barack Obama to require all scientific journal articles resulting from US taxpayer-funded research to be made freely available online. The signatures, obtained within a week of the petition's launch after an active social media campaign, put it over two-thirds of the way towards the threshold that will require an official response from the White House.

It comes as the University of California, San Francisco (UCSF) ? one of the largest biomedical institutions in the United States ? becomes the latest institution to require its researchers to make their articles freely available in an open-access repository. However, they can opt out if it brings them into conflict with publishers. The Massachusetts Institute of Technology in Cambridge and various Harvard University schools are among those with similar policies in place.

The petition, on the White House website, was launched by Access2Research, a group of four open-access advocates who were frustrated by the lack of progress on the issue and so are trying a new tack. The petition urges the president to ?act now to implement open access policies for all federal agencies that fund scientific research?.

The National Institutes of Health (NIH) in Bethesda, Maryland, is the only US government agency that requires researchers to deposit their articles in the agency's PubMed Central online archive within 12 months of publication, a policy that followed a bill passed by Congress in 2007. It is estimated that about 90,000 papers are deposited each year, with half a million people accessing the database of 2.4 million papers each day.
Getting the ball rolling

?We know the NIH policy works to provide public access and there have been no data presented that it hurts publishers? revenues, so we are asking for that policy to be extended,? says John Wilbanks, a senior fellow at the Ewing Marion Kauffman Foundation in Kansas City, Missouri, and one of the four people spearheading the petition.

The proposed extension would see open-access polices cover all 12 federal-science agencies, including the Department of Energy, the National Science Foundation, NASA, the Environmental Protection Agency and the Department of Agriculture. The petition does not stipulate a time period within which articles should be deposited or a particular repository, to give agencies flexibility, Wilbanks says.

The agencies together receive about US$60 billion in federal research dollars each year, with about half going to the NIH, so the number of papers available annually could double under the proposal, says Heather Joseph, another petition leader and executive director of the pro-open access Scholarly Publishing and Academic Resources Coalition, based in Washington DC.

Assuming the petition tops 25,000 signatures before 19 June, there must be an official response from the administration. ?It at least puts the issue in front of the president's staff for consideration. The response could be as weak as a simple acknowledgement, or as strong as a policy statement or directive?, such as an executive order telling agencies to expand the NIH policy, Joseph adds.

The timing of the petition is no accident. A bipartisan bill ? the Federal Research Public Access Act (FRPAA) 2012 ? that advocates extending the NIH policy to other federal agencies, and shortening the time frame in which papers must be deposited from 12 months to 6, is making its way through Congress. The White House is also currently reviewing its open-access policies.

?We want the White House to state its position because it could get the ball rolling with agencies, and we want FRPAA because it is much harder to overturn,? says Joseph.

People smile when they are frustrated, and the computer knows the difference

ScienceDaily (May 28, 2012) ? Do you smile when you're frustrated? Most people think they don't -- but they actually do, a new study from MIT has found. What's more, it turns out that computers programmed with the latest information from this research do a better job of differentiating smiles of delight and frustration than human observers do.

The research could pave the way for computers that better assess the emotional states of their users and respond accordingly. It could also help train those who have difficulty interpreting expressions, such as people with autism, to more accurately gauge the expressions they see.

"The goal is to help people with face-to-face communication," says Ehsan Hoque, a graduate student in the Affective Computing Group of MIT's Media Lab who is lead author of a paper just published in the IEEE Transactions on Affective Computing. Hoque's co-authors are Rosalind Picard, a professor of media arts and sciences, and Media Lab graduate student Daniel McDuff.

In experiments conducted at the Media Lab, people were first asked to act out expressions of delight or frustration, as webcams recorded their expressions. Then, they were either asked to fill out an online form designed to cause frustration or invited to watch a video designed to elicit a delighted response -- also while being recorded.

When asked to feign frustration, Hoque says, 90 percent of subjects did not smile. But when presented with a task that caused genuine frustration -- filling out a detailed online form, only to then find the information deleted after pressing the "submit" button -- 90 percent of them did smile, he says. Still images showed little difference between these frustrated smiles and the delighted smiles elicited by a video of a cute baby, but video analysis showed that the progression of the two kinds of smiles was quite different: Often, the happy smiles built up gradually, while frustrated smiles appeared quickly but faded fast.

In such experiments, researchers usually rely on acted expressions of emotion, Hoque says, which may provide misleading results. "The acted data was much easier to classify accurately" than the real responses, he says. But when trying to interpret images of real responses, people performed no better than chance, assessing these correctly only about 50 percent of the time.

Understanding the subtleties that reveal underlying emotions is a major goal of this research, Hoque says. "People with autism are taught that a smile means someone is happy," he says, but research shows that it's not that simple.

While people may not know exactly what cues they are responding to, timing does have a lot to do with how people interpret expressions, he says, For example, former British prime minister Gordon Brown was widely seen as having a phony smile, largely because of the unnatural timing of his grin, Hoque says. Similarly, a campaign commercial for former presidential candidate Herman Cain featured a smile that developed so slowly -- it took nine seconds to appear -- that it was widely parodied, including a spoof by comedian Stephen Colbert. "Getting the timing right is very crucial if you want to be perceived as sincere and genuine with your smiles," Hoque says.

Jeffrey Cohn, a professor of psychology at the University of Pittsburgh who was not involved in this research, says this work "breaks new ground with its focus on frustration, a fundamental human experience. While pain researchers have identified smiling in the context of expressions of pain, the MIT group may be the first to implicate smiles in expressions of negative emotion."

Cohn adds, "This is very exciting work in computational behavioral science that integrates psychology, computer vision, speech processing and machine learning to generate new knowledge ? with clinical implications." He says this "is an important reminder that not all smiles are positive. There has been a tendency to 'read' enjoyment whenever smiles are found. For human-computer interaction, among other fields and applications, a more nuanced view is needed."

In addition to providing training for people who have difficulty with expressions, the findings may be of interest to marketers, Hoque says. "Just because a customer is smiling, that doesn't necessarily mean they're satisfied," he says. And knowing the difference could be important in gauging how best to respond to the customer, he says: "The underlying meaning behind the smile is crucial."

The analysis could also be useful in creating computers that respond in ways appropriate to the moods of their users. One goal of the research of Affective Computing Group is to "make a computer that's more intelligent and respectful," Hoque says.

Do we put as much energy and time into those vital parts of our lives? Most people do not. Here are some tips to help boost the emotional energy that will create loving and lasting bonds.

Say ?I love you? at appropriate times. Hearing the words makes a difference to most people. You may think they know, but the truth is that everyone wants the verbal reassurance, provided it doesn?t come from a place of desperation. If you are feeling desperate, you?d best seek some advice on how to rebalance the relationship.

Make plans to do something you love with the person you love. You may not be able to do something every day, but knowing you will have the opportunity soon will give both of you something to look forward to, and that builds your happiness bank account.

If you are holding an old anger toward yourself or someone you love, learn to let go of it. As simple as it sounds, we all know that letting go of anger takes self-discipline, patience and plenty of internal strength. The benefit is that you will rediscover and open a receptive heart that now has room in it for more warmth and affection, rather than rancor.

In new relationships, give yourselves some time to get to know each other. In longer-term relationships, it?s just as important, if not more, to spend time together. Talk about your history (or her story) and let your partner in on some of your past that he or she may not know about. It will bring you closer, guaranteed.

Allow yourself to trust your partner. We all have doubts in certain areas, where we find it difficult to completely trust the other person. It might be concerning money, or the kids, or any number of other issues where trust is missing. The important thing here is to talk about the issue and then make an effort to recover what was lost. Give your partner the opportunity to show you he or she has grown.

Talk, email and text daily. Keeping in close contact throughout the day will make you both feel closer ? and it does wonders for your love life. We all need to know that the one we love thinks of us often. If staying in touch throughout the day is difficult, make sure you connect as often as possible.

By doing this emotional homework, you will give yourself and your relationship the opportunity to get back on a positive track and enjoy the fulfillment it brings. What both of you want from the relationship is usually within reach. Begin with a gentle discussion and then give it your best effort in following through. Remember that a relationship worth having is worth cultivating.

China launches telecommunication satellite - Indiatalkies.com

Beijing, May 27: China successfully launched a telecommunication satellite into orbit Saturday night.

The ChinaSat 2A was launched at 11.56 p.m. using a Long March-3B carrier rocket from Xichang Satellite Launch Centre in Sichuan province, Xinhua reported.

According to China Satellite Communications Co. Ltd., the satellite developed by China Academy of Space Technology is meant to meet the demands of China?s radio and TV broadcasting and broadband multimedia transmissions.

Saturday?s launch marked the 163th mission of the Long March carrier rocket series developed by China Academy of Launch Vehicle Technology under China Aerospace Science and Technology Corporation.

Researchers at the International Centre for Radio Astronomy Research (ICRAR) are celebrating today after hearing that Australia will share in hosting the world's largest telescope the Square Kilometre Array (SKA). ICRAR a joint venture between Curtin University and The University of Western Australia has been working towards the $2 billion SKA since its launch in 2009.

"We've been working very hard to make SKA a reality and we're glad to see the project reach this major milestone. ICRAR is looking forward to taking part in the next stage of the SKA through our expertise in Engineering, Information Technology and Astronomy," says ICRAR Director Professor Peter Quinn.

Two candidate sites have been bidding to host the SKA, one in Southern Africa and one in Australia and New Zealand, since 2005. It was announced earlier today by the International SKA Organisation that the SKA would be split between both sites.

Professor Quinn said sharing the SKA between Africa and Australia allows the project to benefit from the best of both sites, building on the substantial investment in infrastructure and expertise that already exists in both locations.

The new plan to share the SKA will see Australia's Mid West hosting two key components of the telescope a group of dishes equipped with Australian-designed multi-pixel radio cameras and the 'Aperture Array' portion, made up of innovative non-moving antennas designed to collect lower frequency radio waves from the whole sky.

This part of the SKA will be optimised to survey large portions of the sky quickly, a particular strength of Australian astronomy.

South Africa will host a complementary group of dish-shaped telescopes designed to observe smaller sections of the sky in more detail, following up on regions of interest discovered using the survey portion.

"This model for splitting the SKA closely follows the workings of other observatories around the world; often separate instruments will survey the sky and inform where another telescope should look closer," says Professor Quinn.

The divide also plays to the strengths of each country's site, relying on Australia's expertise developed during the design and construction of radio astronomy survey instruments, such as the Australian SKA Pathfinder (ASKAP) and the Murchison Widefield Array (MWA).

ICRAR's Curtin University node is the Lead Organisation of the MWA, the only low-frequency Precursor to the SKA, and as a founding member of the predominantly European 'Aperture Array Design and Construction' consortium, ICRAR is applying its expertise to the SKA's new-generation Aperture Arrays.

In particular, we are pleased that our early initiatives in the Aperture Array domain and towards the MWA have proved important in bringing the SKA to Australia. ICRAR's node at The University of Western Australia has been working with international institutions to cost and develop a design for the SKA's extremely powerful computing systems.

The Vice-Chancellor of The University of Western Australia, Professor Paul Johnson, said UWA welcomed the opportunity to play a key role in this historic quest to advance human knowledge of science and the Universe. "Hosting part of the Square Kilometre Array in Western Australia will enable researchers at ICRAR's UWA node to make a significant contribution to this ground breaking telescope project. Their work on high performance computing systems for astronomy and sky surveys will help lead a dramatic advance in international astronomy using new-generation telescopes around the world."

Professor Quinn said that ICRAR is a world leader in survey science and technology in both radio and optical astronomy, and is looking forward to playing a major role in SKA surveys.

Due to the investment already present in both sites, a split SKA will be able to achieve its scientific goals without substantial added costs.

"Placing a major part of the SKA here shows international recognition of Australia's strength in radio astronomy and the high quality radio-quiet site Australia has developed in WA's Mid West," says Professor Quinn.

It also recognises the significant investment made by the WA Government, the Australian Federal Government, CSIRO, and the ICRAR joint venture partners, to turn Western Australia into a hub for world-class science and engineering. Before the SKA starts observations in 2019, the MWA and ASKAP projects, together with iVEC's new $80 million Pawsey Supercomputing Centre, and ICRAR itself, will produce excellent science on the path to the SKA.

"These global science endeavours will continue to benefit Western Australia and the international scientific community long into the future. The effort Australia and WA has made in infrastructure, legislation and policies will make the Murchison Radio-astronomy Observatory a significant centre for global science for decades to come," says Professor Quinn.

"As an International centre, we're eager to continue our work with colleagues in Africa and the rest of the world to build the SKA and use it to explore the Universe in 10,000 times more detail than ever before."
