Nintendo has announced a Maryland US District judge dismissed a patent infringement suit brought against the company by IA Labs CA, LLC which claimed the Wii Fit, Wii Fit Plus products infringed on one its patents.
IA Labs claimed the products were a willful infringement by Nintendo following a meeting it had with the firm in December 2007.
Wii Fit was released in Japan on December 1, 2007, and as Shack points out, the time disparity makes IA?s claim a bit silly.
?We refuse to succumb to patent trolls,? said Nintendo?s senior VP of legal & general counsel Rick Flamm. ?Nintendo has a passionate tradition of developing innovative products while respecting the intellectual property rights of others.
?We vigorously defend patent lawsuits when we firmly believe that we have not infringed another party?s patent.?
This is the third patent victory in court for Nintendo this year alone, according to the firm.
